Information on the processing of personal data of users interested in being contacted

This information notice describes how ProfiMed S.r.l. collects, stores, and uses the personal data of users (“Users”) who fill out the form in the "Contacts" section ("Contact Form") on the ProfiMed website (“Site”), in accordance with Regulation (EU) 2016/679 (the “GDPR”) and any other applicable European Union or Member State regulations regarding privacy (together, the “Privacy Regulations”).

1. DATA CONTROLLER AND CONTACT INFORMATION

The Data Controller is ProfiMed S.r.l., with its registered office at Via P.F. Moia 86/90, 20861 Brugherio (MB), VAT number 07688980155, and can be contacted by email at info@profimed.it (“ProfiMed,” the “Company,” or the “Data Controller”).

2. CATEGORIES OF DATA PROCESSED, PURPOSES, LEGAL BASIS FOR PROCESSING, AND RETENTION PERIOD

i. To manage and respond to the request for information or any type of request submitted by the User through the Contact Form.

The legal basis is the execution of pre-contractual measures requested by the User (Art. 6, para. 1, lit. b) GDPR) and to ensure that the User receives a response to their request from ProfiMed.

Required data in the Contact Form:

  1. First Name;
  2. Last Name;
  3. Company;
  4. Email address.

Optional data in the Contact Form:

  1. Phone number.
  2. Message content.

Personal data will be retained for the time strictly necessary to respond to and process the User's request. Afterward, the data will be deleted.

ii. To fulfill legal obligations and generally comply with applicable laws.

The legal basis is compliance with a legal obligation to which ProfiMed is subject (Art. 6, para. 1, lit. c) GDPR).

  4. Email address.

Optional data in the Contact Form:

  1. Phone number.
  2. Message content.

Personal data will be retained for the period necessary to fulfill legal obligations.

iii. To manage potential disputes.

The legal basis is the legitimate interest of ProfiMed in defending its rights (Art. 6, para. 1, lit. f) GDPR).

Required data in the Contact Form:

  1. First Name;
  2. Last Name;
  3. Company;
  4. Email address.

Optional data in the Contact Form:

  1. Phone number.
  2. Message content.

Personal data will be retained for the time necessary to protect the rights and/or interests of ProfiMed and/or third parties and to carry out any corporate operations, in compliance with ordinary prescription periods.

3. SCOPE OF CIRCULATION AND RECIPIENTS OF PERSONAL DATA

Personal data will be processed exclusively by authorized personnel of ProfiMed, solely for the purpose of carrying out the above-mentioned purposes, and they will be given specific instructions for processing.
Personal data may also be disclosed to the following categories of recipients:

  1. Subjects who provide services on behalf of ProfiMed, designated as data processors (e.g., IT service providers);
  2. Public or private entities (e.g., insurance companies, banks, legal consultants, public authorities, judicial bodies) who will process the data as independent data controllers.

Personal data will not be disseminated, except when necessary to fulfill legal obligations.

4. TRANSFER OF DATA OUTSIDE THE EUROPEAN ECONOMIC AREA

Personal data will not be transferred outside the European Economic Area.

5. RIGHTS OF THE DATA SUBJECT

Pursuant to Articles 15-22 of the GDPR, the User, as the data subject, can exercise specific rights by contacting the Data Controller, including:

  • Right of access: Request confirmation from the Data Controller whether personal data is being processed and, if so, request access to the relevant information.
  • Right of rectification: Request the Data Controller to correct inaccurate or incomplete data.
  • Right of erasure: Request the Data Controller to delete personal data.
  • Right to restriction of processing: Request the Data Controller to restrict processing.
  • Right to data portability: Request the Data Controller to provide personal data in a commonly used and machine-readable format or transmit it directly to another controller, where technically feasible.
  • Right to object: Object, in whole or in part, on legitimate grounds, to the processing of personal data.

Without prejudice to any other administrative or judicial remedy, the User has the right to lodge a complaint with the competent supervisory authority if they believe the processing of their data violates the GDPR, as set out in Article 77 of the GDPR.
