Terms and Conditions of Use of the ProfiMed Website

The website www.profimed.it (“Site”) is the exclusive property of ProfiMed S.r.l., with its registered office at Via P.F. Moia 86/90, 20861 Brugherio (MB) (VAT number 07688980155) and can be contacted by email at info@profimed.it (“ProfiMed” or the “Company”).

By accessing the Site, the user/visitor (“User”) agrees to comply with the following Terms and Conditions (“T&C”). Accessing, browsing, and using the Site implies unconditional acceptance of these T&C. If the User does not accept these T&C, they must refrain from using the Site. The Site and its contents are for informational purposes only.

Access to the Site and Usage Limitations

The User guarantees that they will access and use the Site exclusively for personal use, in compliance with these T&C and applicable laws. Any commercial or advertising use of the Site by the User is excluded.

The User undertakes not to engage in any behavior intended to halt, even temporarily, damage, or interfere with the proper functioning of the Site and its servers, or any activity conducted on the Site and its servers. The User will refrain from uploading to the Site and/or sending via email any files containing viruses, codes, software, or other elements that may damage or interfere with the functioning of the Site or its servers.

It is prohibited to perform massive data extraction operations, fragment sections of the Site, or incorporate them into third-party websites unrelated to ProfiMed. The User may not attempt to test the vulnerability of the Site, circumvent its security measures, or breach its security without prior written consent from ProfiMed.

It is expressly forbidden for any User of the Site (whether they are a provider, distributor, or user of AI systems or models, or otherwise fall under the operators defined in Article 3 of Regulation (EU) 2024/1689 – “Artificial Intelligence Act”) to use any content from the Site for training an artificial intelligence algorithm or model.

Regarding the “Contact Us” and “Newsletter” forms, the User agrees, under their responsibility, to:

  1. Use the forms for their intended purpose and for no other purposes;
  2. Provide ProfiMed with truthful information relating to their person and refrain from submitting data about third parties without their prior consent;
  3. Not send defamatory, obscene, slanderous, or otherwise unlawful messages or any communication contrary to decency or applicable legal provisions or in violation of third-party rights through the “Contact Us” form, any other part of the Site, or via email to the email addresses listed on the Site;
  4. Not submit health-related queries or personal health-related issues through the “Contact Us” form, any other section of the Site, or via email to the email addresses on the Site.

ProfiMed will not process requests of the type outlined in letter (d) and assumes no responsibility for health-related information provided by the User through the “Contact Us” form.

In case of suspected or diagnosed medical conditions, or any symptoms or episodes that raise concerns, the User is required to consult a doctor or another qualified professional.

If the User violates the provisions above or any other obligation imposed on them under these T&C, ProfiMed reserves the right to suspend, limit, or block access to the Site without prior notice and to take legal action for any damage or harm caused by the User’s actions or omissions.

Intellectual Property Rights on the Site

The Site and every element and component of it are the exclusive property of ProfiMed or are legitimately available to it.

The text, documentation, images, characters, graphics, sounds, web pages, videos, trademarks, logos, and any other materials or content present on or accessible through the Site, as well as the software, databases, and codes used to implement the Site (collectively, the “Content”), are protected by laws governing industrial and intellectual property rights, copyright, and related rights, or other applicable laws.

Unless expressly stated, the Content of the Site may not, in whole or in part, be copied, modified, reproduced, including by creating derivative works, translated, transferred, uploaded, downloaded, published, displayed, deleted, distributed, or sold for advertising and/or commercial purposes, in any way without the prior written consent of ProfiMed.

The User agrees not to use the name “ProfiMed” or the Content of the Site for commercial, advertising, or any other uses, including as website URLs, without the explicit written authorization of ProfiMed. The User is allowed to save Content on their computer or print excerpts from the Site’s pages exclusively for personal use, keeping and reproducing any intellectual property notices contained in the Content.

Limits and Exclusion of Liability

Accessing, browsing, and using the Site is at the User’s sole risk and responsibility.

ProfiMed shall not be liable, and shall not be required to indemnify the User for any damage or loss they may suffer:

  1. Due to any errors, omissions, or inaccuracies of any kind related to the Content present on the Site, or any use made of such Content by third parties;
  2. For any negative consequences arising from access to the Site, its functioning, or downloading and using the Content from the Site;
  3. For the content of messages sent by Users via the “Contact Us” form;
  4. For any incorrect, false, or misleading information, or for any communication regarding the User’s health status or health-related issues transmitted via the “Contact Us” form, the “Newsletter” form, or via email to the addresses on the Site.

Links to Third-Party Websites

The Site contains links and connections to third-party websites over which ProfiMed has no control.
Accessing, browsing, and using third-party websites is at the User’s own risk and responsibility, and may involve risks such as viruses. The use of third-party sites will be governed by the terms and conditions of those sites and their respective privacy policies, including cookie policies.

Processing of Personal Data

The personal data of Users of the Site will be processed in compliance with data protection laws, including, by way of example but not limited to, Regulation (EU) 2016/679 on personal data protection (“GDPR”), national privacy laws (for Italy, Legislative Decree 196/2003 and subsequent amendments, “Privacy Code”), and the provisions of the Data Protection Authority and any other competent authority at the European level.

Applicable Law and Jurisdiction

These T&C are governed by Italian law, and the Court of Milan (Italy) shall have exclusive jurisdiction for any disputes arising in connection with these T&C.

Changes to the T&C

ProfiMed reserves the right to periodically modify and update these T&C. The User is encouraged to consult this page periodically to be aware of any updates, as such updates are binding for the User who accesses, consults, and uses the Site.

The new T&C will automatically take effect when published online on the Site.
